Former budget secretary Florencio Abad and Senators Antonio Trillanes, Leila de Lima and Franklin Drilon, will soon face charges in connection to the PHP10-billion (USD200-million) pork barrel scam, Justice Vitaliano Aguirre II revealed Monday.<br />
<br />
Aguirre said the charges will be filed in the coming days by businesswoman Janet Lim Napoles, the alleged brains behind the scam that funneled lawmakers’ Priority Development Assistance Fund (PDAF) into bogus non-government organizations.<br />

“Nakausap ko na po actually ang kanyang lawyer. Ang sabi niya, in a few days, maglalabas na sila ng kaukulang habla at ifa-file ata nila iyun sa DOJ,” Aguirre said in a phone interview with morning talk show “Umagang Kay Ganda.”(I have talked with her lawyer. Last May, the Court of Appeals acquitted Napoles in the alleged illegal detention of her distant relative and corruption whistleblower Benhur Luy.<br />
<br />
The administration then floated the idea of turning Napoles into a state witness in its re-investigation of PDAF misuse under the Aquino government.<br />
<br />
President Rodrigo Duterte has accused the previous administration of shielding its allies from the pork barrel raps.<br />
<br />
Aguirre however denied that the new pork barrel probe was a ploy to discredit previous administration officials.<br />

“Iyan lamang ay pagpapatupad ng katarungan sapagkat kung ikaw ay nagkasala, at alam naman natin na kung ikaw ang namuno lalong-lalo na sa napakalaking pag-rape sa ating kabang bayan, wala pong paghihiganti po,” the Justice secretary said. He also guaranteed that Napoles will not be absolved from her separate plunder raps if and when she turns state witness in the PDAF investigation.<br />

MANILA, Philippines — Sens. Franklin Drilon and Antonio Trillanes IV on Monday morning denied any involvement in any irregularities regarding government funds such as the Priority Development Assistance Fund and the Disbursement Acceleration Program.<br />

The senators issued the statement after Justice Secretary Vitaliano Aguirre II claimed they are among the officials who would face charges after being named by pork barrel scam mastermind Janet Lim-Napoles as involved in the PDAF case.<br />
<br />
"I was never even mentioned in any of the so-called Napoles lists provided during the height of the investigations in 2013," Trillanes said in a released statement.<br />
<br />
Likewise, Drilon said in a statement: "I have said this many times before and I will say it again: I vehemently deny any insinuation by the Secretary of Justice that I was involved in any wrongdoing regarding the Priority Development Assistance Fund (PDAF)."<br />
<br />
In May 2014, Napoles released 100 names that she claimed she allegedly had transactions with in connection with the PDAF allocation to her non-government organizations from 2007 to 2009. In the list, she named 20 senators who allegedly received funds meant for their election campaigns.<br />
<br />
Trillanes and Drilon were not part of that list. The only current senators included in it were Senate President Aquilino "Koko" Pimentel, Sens. Vicente "Tito" Sotto III, Gregorio "Gringo" Honasan, Loren Legarda, Cynthia Villar, Alan Peter Cayetano and Francis "Chiz" Escudero.<br />

However, Aguirre said Napoles would release a new list which would include Sens. Leila de Lima, Trillanes, Drilon and former Budget Secretary Florencio Abad. Abad was already included in the 2014 list.<br />
<br />
"This is outright black propaganda and political harassment intended to silence the members of the opposition," Drilon said. "We would await the copy of the affidavit. We will respond at the proper time and in the proper venue," he added.<br />
<br />
Aguirre earlier said Napoles will reveal other higher officials under the Aquino administration who are involved in the PDAF scam. Trillanes then criticized the justice secretary for involving members of the opposition in various cases.<br />
<br />
"Aguirre has been using his office to persecute and harass members of the opposition by fabricating testimonies from dubious convicts or detainees such as the Bilibid drug lords, Kerwin Espinosa and now Napoles," Trillanes said.<br />
<br />
Drilon in a statement Monday echoed this, saying that the intention is obvious from the personalities being linked.<br />
<br />
"Sinu-sino ba ang target ng administrasyon: former President Benigno Aquino, former Budget Secretary Florencio Abad, Senator Sonny Trillanes, detained Senator Leila De Lima, and myself," he said.<br />
<br />
"If this is not revenge, I don't know what it is."<br />
<br />
For his part, Aguirre said this is not a ploy to discredit the Aquino administration nor take revenge against Duterte administration's critics. He said there is no reason for the president to do so.<br />

Senator Leila de Lima on Tuesday chided Senate President Aquilino “Koko” Pimentel III for supposedly acting like the Justice secretary in “opposing” her plea for occasional furlough that would allow her to participate in crucial bills.<br />
<br />
“Instead of considering the merits of my request, apparently the Senate President instead has himself dug up jurisprudence against it,” De Lima, who is presently detained over drug-related charges, said in a statement.<br />
<br />
“Senator Koko Pimentel is the Senate President, not the Secretary of Justice. He is opposing a detained senator’s performance of her mandate as if he was the government prosecutor. He should let the DOJ prosecutors argue against me, and not ahead of them,” she added.<br />
<br />
On Monday, Pimentel called De Lima’s plea for support from the Senate leadership as “propaganda.”<br />
<br />
De Lima, former election lawyer of Pimentel, said the Senate President’s statement “trivializes” the legitimacy of her request.<br />
<br />
“I cannot understand the hostility of the Senate President to a simple request for help from a fellow senator who is in detention to perform her mandate,” De Lima said.<br />
<br />
“He is there to look after the other senators and to make sure that they are able to perform their mandate to the extent possible and allowed by law,” she added.<br />

Senator Antonio Trillanes IV on Monday chided members of the House justice committee for junking the impeachment complaint filed against President Rodrigo Duterte, saying they are either scared of the administration or believe that there is nothing wrong with extrajudicial killings (EJKs).<br />
<br />
“Buong mundo na ‘yung nakakapuna bukod lang sa mga pagpatay ng libo-libo, pagnanakaw ng bilyon-bilyon at secret dealings with China. Mabibigat ito,” Trillanes told reporters in an interview.<br />
<br />
“It’s either natatakot sila or talagang gusto nila or nakikinabang sila sa administrasyon or worse, naniniwala sila na tama yung pinaggagagawa ni Duterte,” he added.<br />
<br />
Trillanes lamented how some congressmen who are also lawyers grilled Magdalo party-list Rep. Gary Alejano on his “personal knowledge” over his accusations against Duterte.<br />
<br />
“Baluktot yung pangangatwiran nitong mga nag-a-abogado kay Duterte,” Trillanes said.<br />
<br />
“‘Yung pinagmamasdan ko nga si Fariñas eh, akala ko maligang na abogado ito, pero hindi niya naiintindihan yung testigo tsaka complainant. Iba yun, those are two different things,” he added.<br />
<br />
During the hearing at the House justice committee, Fariñas grilled Alejano on the points raised in the complaint, starting with the spate of alleged EJKs.<br />
<br />
“You took it upon yourself to state under oath that you have personal knowledge on this, but now you’re saying hindi pala,” Fariñas said.<br />
<br />
Fariñas indicated that Alejano violated Paragraph 3 of the verification of complaint, where a complainant swears under oath that all his allegations are “true and correct” to his personal knowledge or via authenticated records.<br />
<br />
“Any complainant who should come before Congress must really stand to this oath,” he said.<br />
<br />
The committee decided to junk the impeachment complaint against Duterte, saying it is "insufficient in substance."<br />
<br />
Trillanes said they will resort to “other modes,” which Duterte’s allies cannot control.<br />
<br />
“Mapapunta na lang tayo sa ibang modes kung papano lalabas ang katotohanan na ito. Sa mga ganung paraan, hindi na nila maco-control,” he said.<br />
<br />
Trillanes and Alejano both belong to the Philippine Military Academy Class of 1995. They are members of the Magdalo group of soldiers who went against President Gloria Macapagal-Arroyo.<br />

Magdalo Rep. Gary Alejano on Monday said he is willing to lose his seat in the House of Representatives over the impeachment complaint he filed against President Rodrigo Duterte.<br />

At the House justice committee hearing on Monday morning, Alejano was questioned notably over his “personal knowledge” on material allegations contained in his complaint.<br />

Upon the insistence of Majority Leader Rodolfo Fariñas, Alejano replied that he did not personally witness any of the thousands of killings linked to Duterte’s war on drugs.<br />

The Magdalo lawmaker and former mutineer had maintained that he based his complaint on “authenticated records” and testimonies of self-confessed Davao Death Squad members, former police officer Arturo Lascañas and hitman Edgar Matobato.

Dito, ipinabasura ni Aquino ang motion for reconsideration na inihain ng mga compalainants dahil wala namang “sufficient ground” para patunayang karapat-dapat siyang kasuhan.<br />

Iginiit ni Aquino na ginampanan lang niya ang “core executive functions” niya bilang pangulo at hindi niya sinapawan ng kapangyarihan ang Kongreso.<br />

Senator and incoming Foreign Affairs Secretary Alan Peter Cayetano on Wednesday said he is willing to resign from his post or be jailed if it can be proven that what he presented at the United Nations Human Rights Council regarding the country's human rights record is proven wrong, a report on Unang Balita on Thursday said.<br />
<br />
Cayetano made the presentation at the Universal Periodic Review before the UNHRC in Geneva, Switzerland regarding the Duterte administration's war on drugs.<br />
<br />
At a press conference in Phnom Penh, Cambodia where he arrived straight from Switzerland, Cayetano said it is his duty to point out the truth regarding the government's war on drugs, GMA News' JP Soriano reported.<br />
<br />
"It is our job to give an accurate report. That's what we gave eh. Will they believe it? It's up to them. Will they not believe it? But we gave our side and then we opened it up to investigation," he said.<br />
<br />
Cayetano also clarified before reporters the number of killings in the Philippines, not all of which are linked to the war on drugs.<br />
<br />
He said the numbers of extrajudicial killings that have been reported to the United Nations are wrong.<br />

"So ang sinasabi ko lang naman, kung gagamitin niyo ‘yung lumang definition, so tanggapin natin na before Duterte came, there was 11 to 16,000 every year, or 77,000 in the last six years…May nakita na naman akong article kanina. Binaba ko daw numbers ko from 77 to 16. Hindi po. Sabi ko, 11 to 16 every year for the last six years. ..Pag in-add mo ‘yung last six years, 70 to 77,000 ‘yan. Depende if you start at 2009 or 2010 ‘no…So the numbers we’ve given, none of them was fuzzy math or creative math. None of them were clocked out. Ito official government statistics and we’re going to deal with it," he said.</blockquote>
During his presentation before the UNHRC in Geneva on Monday, Cayetano said there was no "sudden wave" of state-sponsored extrajudicial killings in the Philippines. He also asked the UNHRC to visit the Philippines to check on the situation. He also underscored the need to make the Philippines, especially the younger generation, safe from the drug scourge.<br />
<br />
Cayetano said that while in Switzerland, he found out that UN Special Rapporteur on Extrajudicial, Summary, or Arbitrary Executions Dr. Agnes Callamard is not an expert in human rights abuses cases.<br />
<br />
"Nagulat ako nung sinabi nung Mission natin 'yun sa ano. No, that's not what she was teaching in Columbia and that's not what her focus was on. It was on government accountability, communications, et cetera 'no. And lalong hindi siya expert sa droga," he said.<br />
<br />
Callamard has not given any statement yet regarding Cayetano's remarks.<br />
<br />
The UN Rapporteur was in the Philippines recently, and on Friday stressed that waging a "war on drugs" like the one employed by the Duterte administration only makes the problem on illegal substance worse, instead of solving it.<br />
<br />
Cayetano headed the 16-man Philippine delegation for UNHRC's UPR.<br />
<br />
At the UPR, which happens every four years, member countries present their human rights records to the UNHRC. The Philippines last participated in the UPR in 2012.<br />
<br />
The period under review was for the last four years of the administration of then-President Benigno Aquino III and the first few months of the Duterte government.<br />
<br />
Duterte has bristled at criticism of his anti-crime policy in which thousands have been killed since he took power on June 30 last year.<br />
<br />
He made several outbursts against the United States, the United Nations, the European Union, human rights groups and other international institutions, and has said he will pursue deeper ties with countries such as Russia and China.<br />

Philippine National Police chief Director General Ronald dela Rosa on Thursday admitted he wants to become a senator one day, but said he was unsure about running in 2019.<br />

Senator Francis "Chiz" Escudero on Thursday said incoming Foreign Affairs Secretary Alan Peter Cayetano should formally resign as a senator before assuming his new post.<br />

"Kailangan pormal siyang mag-bitiw. Pero hanggang hindi siya nagbibitiw at nag-assume ng position ng secretary, hindi niya maaaring gampanan nang buong-buo 'yung kanyang tungkulin bilang kalihim," Escudero said during the "Kapihan sa Senado."<br />

"Dahil kung siya'y acting lamang, hindi siya pwede mag-appoint ng permanente, hindi siya puwedeng pumirma ng voucher hanggang hindi siya nagre-resign bilang senador at hanggang hindi siya na-coconfirm formally ng Commission on Appointments, lalo na in session ang Congress sa pagkaka-appoint sa kanya," Escudero added.<br />

He further said: "Hindi ito ad interim appointment kung saan buong-buo na ang kanyang kapangyarihan. Kailangan niya yung kanyang confirmation."<br />

Cayetano had earlier clarified that he was nominated by the President to the post. Meaning, he needs to be confirmed first before taking his oath of office.<br />
<br />
"The nomination has been signed but I cannot take the office and the oath until confirmed by the Commission on Appointments," he said.<br />
<br />
"That’s why you have a statement from Senator Ping. At nagpapasalamat ako sa kanya that he’s planning a, you know a, the confirmation and nakikiusap sa mga kasamahan namin dahil kasama din sa CA and we work together ‘no to speed up the process," he added.<br />
<br />
Cayetano was appointed by President Rodrigo Duterte on Wednesday as the secretary of the Department of Foreign Affairs.<br />
<br />
He told reporters that he signed Cayetano's appointment papers right before he left for Ninoy Aquino International Airport for his trips to Cambodia, Hong Kong, and China.<br />
<br />
Cayetano is the chairman of the Senate Committee on Foreign Relations.<br />

The Commission on Human Rights is facing its “toughest challenge” ever —“crisis of democracy,” detained Senator Leila de Lima said Friday.<br />

De Lima, a former CHR chief, said the country is in a crisis “where citizens are silenced amid the prevalence of flagrant violations of our fundamental rights.”<br />
<br />
“[It is] where lies and rumors are fabricated to poison our minds by some forces in our State for the sake of their political and personal agendas.”<br />
<br />
De Lima, a staunch critic of President Rodrigo Duterte, is currently detained at the PNP Custodial Center in Camp Crame over her alleged involvement in the proliferation of illegal drugs inside the national penitentiary during her term as Justice secretary.<br />
<br />
She was the chairperson of the CHR during the administration of former President and now Pampanga Rep. Gloria Macapagal-Arroyo.<br />
<br />
During her stint at the commission, she led the investigation on the killings allegedly perpetrated by the so-called Davao Death Squad, supposedly upon orders of Duterte, then Davao City's mayor.<br />
<br />
“It is in this institution (CHR) where I learned the value of human life and human dignity, regardless of one’s status,” De Lima said.<br />
<br />
“Now more than ever, the commission needs to have a united stand in fighting this crisis, to continue fighting for the welfare and rights of our people, especially the marginalized who are often the victims of injustice in our society,” she added.<br />
<br />
The CHR, under chairperson Chito Gascon, is celebrating its 30th founding anniversary Friday.<br />
<br />
United Nations special rapporteur on extrajudicial killings Agnes Callamard was one of the guest speakers at the CHR's pre-anniversary event on Thursday evening.<br />

Trillanes quoted confessed hit man SPO3 Arturo Lascañas, a former Davao City policeman, who said he had suggested to the President’s trusted aide that the killing be made to look like an accident.<br />
<br />
The senator was reacting to a statement from Justice Secretary Vitaliano Aguirre II in a pro-Duterte rally in Luneta on Saturday that the government would go after him next to staunch presidential critic, Sen. Leila de Lima, who was arrested last week on drug charges and is now detained in Camp Crame.<br />
<br />
Trillanes said he was actually the first on the hit list of Mr. Duterte.<br />
<br />
“Actually, I was supposed to be the first [on the list] but they wanted me dead. They will not file cases against me but have me killed. Lascañas was told about this after Mr. Duterte won the presidency and it was because the latter was very angry at me. So they want to have me killed from the very start,” he said in a radio interview.<br />
<br />
Contacted by phone, Trillanes gave more details of what Lascañas had told him when they first met. This was after the retired policeman had sought help from an emissary to reach out to the senator last January.<br />
<br />
According to Trillanes, Lascañas told him that when Mr. Duterte won the election last year, he was approached by the latter’s trusted aide and driver, retired SPO4 Sonny Buenaventura.<br />
<br />
“Lascañas was asked by Buenaventura what he thought about killing me because Duterte was very angry at me,” Trillanes told the Inquirer.<br />
<br />
Trillanes has drawn the ire of the President after the senator revealed a few days before the May election that Mr. Duterte had P2 billion in his bank accounts. Mr. Duterte denied the charge but admitted he had a bank account in one of the branches of the bank that Trillanes had identified.<br />
<br />
But Trillanes said Lascañas had told Buenaventura it would be difficult killing the senator.<br />
<br />
“It was too big a project for them. They were used to killing small targets like petty criminals. If ever, their biggest target was Jun Pala,” the senator said.<br />

Last week, Lascañas, who had come out to say he was a member of the Davao Death Squad under the control and pay of Mr. Duterte since he was mayor of Davao City, claimed he was among those who killed Pala, a hard-hitting radio anchor whose favorite subject was the President.<br />

Trillanes said Lascañas had also told Buenaventura that killing the senator would result in a big backlash on the President.<br />

“It’s because they know the investigation into my killing would be a tough one and some of those behind it might squeal, and that was why it would be difficult to accomplish,” Trillanes said.<br />

And because he did not want to take on the job of killing Trillanes, Lascañas said that he made suggestions to Buenaventura that they make the killing look like an accident such as causing a truck to slam into Trillanes’ vehicle.<br />

Trillanes said the retired policeman had told him that there were others that the Duterte administration wanted killed, which he would reveal more about when he testifies before the Senate on Thursday.</div>

A News To Go report said that according to CHR Commissioner Gwendolyn Pimentel-Gana, accusations that Duterte is behind the alleged extrajudicial killings should be backed up by data and not just by the president's remarks egging policemen to kill resisting drug suspects during operations.<br />

Gana also said that the CHR has yet to get proof that vigilante-style killings are state-sponsored.<br />
<br />
“We have not actually found that it's [an] institutionalized policy of government. We're looking at the individual cases," she said.<br />
<br />
She said what they have found out is that some rogue members of the government's security force are involved in vigilante-style killings, which she said could not be branded extrajudicial killings unless these are proven as state-sponsored.<br />
<br />
"What we have actually seen is that there are security forces, do they call them scalawags or what, relly involved in the killings," Gana added.<br />
<br />
On Monday, the New York Times released a video documentary on the war on drugs in the country titled "When a President Says, 'I'll Kill You'."<br />
<br />
The New York Times also published an editorial last Friday calling on other nations to put pressure on Duterte amid the rising death toll in the Philippines' war on drugs.<br />
<br />
Meanwhile, Gana said that the Philippine National Police should act on the spate of killings in the country.<br />
<br />
PNP chief Director General Ronald dela Rosa insisted on Monday that there are no extrajudicial killings in the country and blamed the media for using the term on homicide cases.<br />
<br />
"Kalimutan niyo ang EJK. Huwag niyo gamitin iyan. Hindi naman talaga sponsored ng state 'yung killing na 'yan e. Hindi sponsored ng PNP, in fact," Dela Rosa said in a press conference.<br />
<br />
In the same press briefing, the PNP chief released data on killings since Duterte took office in July 2016.<br />
<br />
Dela Rosa said the PNP had recorded more than 6,000 homicide cases from July 1, 2016 to Mar. 24, 2017.<br />
<br />
He said they released the data to clarify reports that there are 7,000 extrajudicial killings amid the government's war on drugs.<br />

The Senate cannot do anything to stop the serving of an arrest warrant on Senator Leila de Lima—if and when that happens—as the offense faced by the neophyte senator is not covered by the immunity granted to members of Congress.<br />
<br />
“That’s quite unfortunate but if that happens, we will see to it that the rule of law is followed,” Senate President Pro Tempore Franklin Drilon told reporters in an interview Monday.<br />
<br />
Following the law only goes as far as ensuring that the arrest warrant is not served inside the Senate session hall “by tradition.” The plenary session is held from Monday to Wednesday at 3 p.m.<br />
<br />
“Theoretically, it can be served, because it is an alleged offense where the penalty is beyond six years. But we will object to any service of the warrant in the session hall,” Drilon, a partymate of De Lima under the Liberal Party (LP), said.<br />
<br />
Article VI, Section 11 of the 1987 Constitution states that “a senator or member of the House of Representatives shall, in all offenses punishable by not more than six years imprisonment, be privileged from arrest while the Congress is in session.”<br />
<br />
De Lima, however, is accused of violating Section 5 of Republic Act 9165 or the Comprehensive Dangerous Drugs Act, which imposes the penalty of life imprisonment and a fine of P50,000 to P10 million.<br />
<br />
<b>Ethics complaint</b><br />
<br />
Meanwhile, Majority Leader Vicente Sotto III said the Senate ethics panel targets to resolve the complaints against De Lima by the end of the month.<br />
<br />
De Lima said she has filed her reply to the complaints filed against her, including the one filed by several House leaders.<br />
<br />
“Tuloy yun. It’s a different story. The issue in the ethics committee is about the conduct of a senator,” Sotto, chairman of the ethics panel, said.<br />
<br />
De Lima argued she should not be penalized for merely giving advice to her former bodyguard-driver Ronnie Dayan to skip the House inquiry on the Bilibid drug trade.<br />
