PO2 Alipio Balo and PO1 Michael Tomas were each charged with two counts of murder, a report by GMA News' Steve Dailisan on 24 Oras said.
“Wherefore, it is respectfully recommended that the attached information for murder (2 counts) against both respondents be filed with the appropriate court/s,” the resolution said.
Jaypee, a drug suspect, was arrested by the Pasay Police in July last year at the height of the Philippine National Police's Oplan Tokhang.
The elder Bertes joined his son at the precinct while he is undergoing booking procedures. The two were later found dead at the precinct.
The suspects said the two allegedly resisted authorities and tried to grab a firearm from them while at the Anti-illegal Drugs office of the Pasay Police.
However, investigations showed Renato suffered from bullet wounds on the head, chest, and left shoulder.
All of which would be impossible if he tried to grab a firearm since he is taller than Balo. The autopsy report said Renato also sustained physical injuries.
The younger Bertes, on the other hand, was shot on the left jaw, right chest, right arm, and on his back and stomach. He also had several bruises, a sign he was first beaten up before being killed.
The Senate Committee on Justice and Human Rights, under its former chair Senator Leila de Lima, also launched a probe on the incident last year.
The prosecutor's office said the evidence showed Balo and Tomas planned to kill the victims.
Jaypee's wife, who refused to appear on camera, said she was not content with the murder charges against the two policemen.
"Finally, ito na yung simula para panagutan nila yung lahat ng kasalanan nila sa amin. Kumbaga para at least ito na rin yung example sa mga pulis," she said.
She also urged Balo and Tomas to admit to their crime. "Umamin na lang sila kasi wala rin silang ligtas. Kahit anong sabihin nila wala silang ligtas. Isa lang ang gusto ko, panagutan lang po nila yung kasalanan nila."
The Bertes family's lawyer said they also filed a case against the suspects for violating the anti-torture and anti-child abuse laws.
"Pinasok na rin po natin dito ang anti-torture law. Iba po ang intension nila nung sinaktan at binugbog yung mag-ama. Inihain din na kasama rito ay yung child abuse dahil kung matatandaan po natin, ayon na rin sa salaysay ng nagrereklamo, pati yung bata ay nadamay," he said.
Meanwhile, Commission on Human Rights spokesperson Atty. Jacqueline de Guia urged the PNP to form a policy that prevents future incidents like that of the Jaypee and Renato Bertes.
"We would like to see what will be the concrete policy recommendations that the PNP itself can come up with to ensure that similar acts will be avoided in the future," De Guia said.
The Pasay PNP declined to issue a statement on the case, saying Balo and Tomas have been absent without official leave since they were placed under the restrictive custody of the Southern Police District.
